About Our Data Processing

In this section, we explain how we process your data, where it is stored, what security measures we employ, and who can access it.

1. Website Software

WordPress and WooCommerce

  • Our website and store are developed using WordPress and WooCommerce.
  • Our web host is Kinsta. Any personal data you provide through our website may be accessible to Kinsta for technical support. Kinsta is contractually obligated not to use your data for any other purpose and must take necessary security measures, such as SSL encryption and strong password policies.
  • Regular backups are made to prevent data loss.

2. Web Hosting

Hoasted

  • We use Hoasted for web hosting.
  • Hoasted processes personal data on our behalf but does not use it for its own purposes.
  • Hoasted may collect metadata about the use of its services, which does not include personal data.
  • Hoasted is required to maintain confidentiality and has implemented technical and organizational measures to prevent loss or unauthorized use of your personal data.

3. Email and Marketing Services

ActiveCampaign

  • We use ActiveCampaign to send out our email newsletters and marketing communications.
  • ActiveCampaign will never use your name or email address for its own purposes.
  • Every email sent via ActiveCampaign includes an “unsubscribe” link. Once you click this link, you will no longer receive our newsletters.
  • ActiveCampaign uses cookies and other internet technologies that allow it to track email open rates. It may use aggregated data to improve its services and may share that aggregated (non-personally-identifiable) data with third parties.

Gmail

  • We use Gmail for our regular business email.
  • Google has taken suitable measures to prevent misuse, loss, or corruption of data.
  • Gmail does not access our inbox, and we treat email traffic confidentially.

4. Payment Processing

Stripe

  • To process (part of) our payments, we use Stripe.
  • Stripe processes your name, address, and residence details and has taken appropriate measures to protect your data.
  • Stripe may use your data in non-personally-identifiable form to improve its services and may share aggregated data with third parties for that purpose.

5. Accounting and Bookkeeping

MoneyBird & Exact Online

  • For our administration and bookkeeping, we use MoneyBird and Exact Online.
  • We provide your name, address, and residence details to these platforms to complete invoices and orders.
  • Both MoneyBird and Exact Online protect your data and must prevent loss or unauthorized use.
  • They do not use your data for their own purposes.

6. Support Desk (Gleap)

  • We use Gleap to handle user support requests. If you contact us for support, we may request access to your store’s backend or other administrative settings to diagnose and resolve issues.
  • Any login credentials you provide for troubleshooting purposes may be stored securely within Gleap.
  • Upon your request, we will delete these credentials and any related data from Gleap and our other systems, in accordance with applicable privacy and data protection laws.

The Purpose of Data Processing

Main Purpose of Processing

We only use your personal data to provide you with our services, which primarily involves processing orders, support requests, and communications. We do not use your data for independent marketing purposes without your explicit consent. We do not share your data with third parties, other than those involved in fulfilling our administrative obligations or delivering services to you.

Automatically Collected Data

Data automatically collected by our website (for example, your IP address, browser, and operating system) is used solely to improve our services. This data is not personal in the sense that it cannot be used directly to identify you.

Cooperation in Tax and Criminal Investigations

In certain circumstances, Opvius may be legally obliged to share your data in connection with governmental or criminal investigations. If this situation arises, we are compelled by law to comply but will resist requests that do not legally require us to share data.

Retention Periods

We retain your data for as long as you remain our customer. This means we keep your profile until you indicate you no longer wish to use our services. Once you terminate your relationship with us, we treat this as a request to delete your data, except for data we are legally required to retain (e.g., financial records). During any mandatory retention period, your data will be archived and accessible only to fulfill legal obligations.

Your Rights

Under applicable U.S. and European data protection laws, you have certain rights regarding the personal data we process. Below, we explain how you can exercise these rights.

To prevent misuse, we typically send copies or data extracts to the email address associated with your account or otherwise on file with us. If you wish to receive your data via a different email address or by postal mail, we may ask you to verify your identity. We keep records of completed requests. If you request deletion of your data, we will maintain anonymized records where necessary. You will receive all statements and copies of data in a machine-readable format.

If you believe we are misusing your data, you have the right to file a complaint with a supervisory authority.

2. Right to Rectification

You have the right to request that we correct any personal data about you that is inaccurate. Submit your request to our privacy contact, and we will respond within 30 days. If approved, we will update the data and send you a confirmation.

3. Right to Restriction of Processing

You have the right to request that we limit our processing of your personal data. Submit your request to our privacy contact, and we will respond within 30 days. If approved, we will cease further processing of your data until the restriction is lifted.

4. Right to Data Portability

You have the right to request that your personal data be transferred to another party. Submit your request to our privacy contact, and we will respond within 30 days. If approved, we will provide your data in a commonly used format. Note that we may no longer be able to provide certain services if essential data connections cannot be maintained.

5. Right to Object and Other Rights

You have the right to object to the processing of your personal data by or on behalf of Opvius in some circumstances. If you object, we will halt processing pending an investigation of your objection. If your objection is valid, we will provide you with copies of the relevant data and cease processing. We do not engage in automated decision-making or profiling that significantly affects you. If you believe otherwise, please let us know.
